Notice of Intended Change or Cessation of Exempted Clinics

What Changes are Considered as Intended Change or Intended Cessation?
Operator(s) of an exempted clinic that hold a valid letter of exemption must make a notice to DH for intended change(s) or intended cessation of the exempted clinic.

Intended changes that result in revocation of exemption
  • Relocation of exempted clinic;
  • Cessation of operation of exempted clinic (including changing the operating partnership / company);
  • Cessation of clinic's operating as a small practice clinic;
  • Change the individual operating the clinic as a sole proprietor (including changing the operating sole proprietor from one individual to another, changing the form of operation to partnership / company);
  • Sole proprietor has become bankrupt or made a voluntary arrangement with the individual's creditors within the meaning of Bankruptcy Ordinance (Cap.6); or
  • Partnership has been dissolved / company has commenced to be wound up or dissolved

Intended changes that result in amendment to the letter of exemption
  • Change of partner(s) / director(s) (only applicable to partnership not dissolved / company not commence to be wound up / dissolved);
  • Change in type of practice (e.g. change from medical practice to dental practice);
  • Change of name of exempted clinic;
  • Amendment of address information (not involving relocation of exempted clinic); or
  • Change of name of existing operator

Other intended changes that must inform DH but will not result in an amendment to the letter of exemption or revocation of exemption
  • Change of company name;
  • Change of contact or correspondence information of exempted clinic / existing operator(s); or
  • Change of Authorized Partner / Authorized Director among existing operators
How to Submit a Notice
  1. Read the Guidance Notes for Notice of Intended Change or Cessation of Exempted Clinics, Guidance Notes for Closure of Exempted Clinics, the intended change or intended cessation notice form ("ICC form") and all relevant forms and documents before making a notice.
  2. Fill in the ICC form through e-Licensing User Guide for e-Licensing
  3. All operators should duly sign the ICC form (if there is an intended change of operator(s), all operators after the change should sign the ICC form)
  4. Prepare all required supporting document(s)
  5. Submit all the documents listed in (3) and (4) through e-Licensing. If you are not able to submit electronically, please submit them by post or contact our office to make an appointment for in-person submission
Fee

Notice of intended change or cessation of exempted clinic is free of charge.

Validity Period of the Letter of Exemption

The validity of the letter of exemption depends on the type of intended change or intended cessation:

For intended changes that result in revocation of exemption

The letter of exemption will become invalid after the issuance of the Notice of Revocation. Operator(s) will have to request another letter of exemption or apply for a licence in order to continue to operate the clinic.

For intended changes that result in amendment to the letter of exemption

A revised letter of exemption will be issued and the previous letter of exemption will cease to be effective.

Other intended changes that must inform DH but will not result in an amendment to the letter of exemption or revocation of exemption

The letter of exemption will remain valid.
